The Pennsylvania Waste Industries Association asked the Monroe County Court of Common Pleas on Wednesday to declare a recent request for proposals issued by the Monroe County Municipal Waste Management Authority to be illegal and invalid.
Bids from landfill operators under the RFP are due Aug. 30. The association has filed paperwork seeking a preliminary injunction, requesting that the court suspend the bidding process pending its decision.
In the RFP, the authority establishes a tipping fee system that would require landfills, in order to dispose of any waste generated in Monroe County, to sell their "airspace" capacity to the authority and allow the authority to set the "tipping fee" — the cost to empty a truck in a landfill — for use of that airspace.
